Terms of service
The short version. Hyfive is free. Use it to share your own business card and keep the cards you receive. Only put on your card what you're allowed to share. Your card and contacts stay on your phone; a card you share by link is kept on hyfive.app until you stop the link. Be fair to the people you meet and to the service. Belgian law applies, and your rights as a consumer always stay.
1. Who we are
Hyfive is made by AMTECCO (Amtecco BV), Antwerp, Belgium, VAT BE0748.398.550 ("we", "us"). These terms are an agreement between you and us about the Hyfive app and hyfive.app (together, "Hyfive"). By installing or using Hyfive you accept them. If you use Hyfive for your company, you accept them for yourself and, where you are allowed to, for your company.
You must be at least 16 to use Hyfive.
2. Hyfive is free
Hyfive is free to use: no subscription, no ads, no account and no in-app purchases. If we ever offer paid extras, we will say so clearly beforehand. Nothing you use for free today will start costing you money without your clear agreement.
3. Your licence to use the app
We give you a personal, non-exclusive, non-transferable right to use Hyfive on the devices you own or control, for personal and business networking. Hyfive, its design, the Hyfive name and the logo remain ours or our licensors'. Please don't copy, resell or rebrand the app, and don't decompile or reverse-engineer it, except where the law allows you to.
4. Your card and what you put on it
- It's yours. You keep all rights to your card: your name, details, links and company logo.
- Only share what you may share. Put only your own details on your card, and only a company name or logo you are allowed to use. Don't pretend to be someone else.
- Links you share. When you share a card by link, you allow us to store that card and its pictures on hyfive.app and to show them to anyone who opens the link, only to make the link work. You can stop a link at any time in the app; we then delete the card and its pictures. See the privacy policy.
- We may remove a shared card that breaks these terms or the law, for example one that impersonates someone, is used for spam or fraud, or infringes someone's rights.
5. The people you meet
Cards you receive are stored on your phone, under your control. Treat other people's details with care: use them to stay in touch, as they would expect from handing you a card, and respect the data protection rules that apply to you (for example the GDPR when you use them for your business). We don't receive or see the people you meet.
6. Fair use
Please don't use Hyfive to:
- break the law or anyone's rights, or share content that is illegal, misleading, hateful or harmful;
- send spam, phish or spread malware through card links;
- collect cards or details from hyfive.app with bots, scrapers or other automated means, or try to guess card links;
- overload, attack or get around the security of hyfive.app or the app.
We may block access to hyfive.app from devices or networks that do this.
7. Privacy and data protection
We protect your data under the GDPR. Hyfive keeps your card and contacts on your phone, has no accounts, no ads and no tracking, and sends data to hyfive.app only when you share a card by link. Data to and from hyfive.app is encrypted in transit and access to our servers is restricted. The privacy policy explains exactly what is used, why and for how long.
8. Other services
Hyfive uses features of your phone and a few services from others, such as QR scanning and location names from Google or Apple and map images from OpenFreeMap (based on OpenStreetMap). Their own terms apply to them. Links on a card can lead to other websites and apps; we are not responsible for them. Your use of Google Play or the App Store is covered by their terms.
9. Changes and availability
We work to keep Hyfive reliable and improve it with updates. Because it is free, we provide it "as is", without a service level agreement: features can change and hyfive.app can occasionally be unavailable, for example during maintenance. Sharing by QR code and by tap works on your phone, without our servers. If we ever stop hyfive.app, we will tell you in the app in good time, so you can keep your cards and contacts on your phone.
10. Liability
- To the extent the law allows, we are not liable for indirect or consequential damage, such as lost business, lost profits or lost data. Keep your own backup of contacts that matter to you.
- To the extent the law allows, our total liability towards you is limited to €50.
- We are not liable for delays or failures caused by circumstances beyond our reasonable control (force majeure), such as outages of networks, app stores or hosting providers.
- None of this limits liability for intent, gross negligence, death or personal injury, or any right you have as a consumer that cannot be limited by contract.
11. Ending
You can stop using Hyfive at any time: stop any links you shared, then uninstall the app (which deletes its data from your phone). We may suspend or end your use of hyfive.app if you seriously or repeatedly break these terms.
12. Apple App Store
If you got Hyfive from the App Store: these terms are between you and us, not Apple. Apple is not responsible for Hyfive or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claims relating to it, including product liability, legal or regulatory claims, or claims that it infringes someone's intellectual property. If Hyfive fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any price you paid (Hyfive is free); Apple has no other warranty obligation. You confirm that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's Licensed Application End User License Agreement applies to the extent these terms don't cover something.
13. Law and disputes
These terms are governed by Belgian law. Disputes go to the courts of Antwerp, Belgium. If you are a consumer, you keep the protection of the mandatory rules of the country where you live and may also go to the courts there. Please contact us first: most things are solved with an email.
14. Changes to these terms
If we change these terms, we update this page and the dates at the top. For important changes we tell you in the app before they apply. If you keep using Hyfive after that, the new terms apply.
